·         CYBERLINKHOST reserved the right to suspend or cancel a customer's access to any or all services provided by CYBERLINKHOST when CYBERLINKHOST decided that the account has been misused.

·         CYBERLINKHOST will not allow any of the following content to be stored on its servers:

1.       Illegal Material- This includes copyrighted works, commercial audio, or music files and any material in violation of any Federal , Provincial or local regulations.

2.       Adult Material- Includes all pornography, erotic images or otherwise nude or obscene content. The designation of adult material is left entirely to the discretion of CYBERLINKHOST.

3.       Wares- Include pirate software, ROMs, emulators, hacking and password cracking. IP spoofing, etc and encrypting of any of the above. Also includes any site which provide "links to" or "how to" information about such material.

·         Resources are defined as bandwidth and / or processor utilization. When a website is found to be monopolizing the resources available, CYBERLINKHOST reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

·         Refunds will not be allowed. However in genuine cases the formal requests with valid reason will be forwarded to higher authorities and if accepted, the refunds will be made accordingly.

·         CYBERLINKHOST will not be responsible for liabilities, losses, costs and claims, including reasonable attorney's fees asserted against CYBERLINKHOST arising out of;

1.       Any injury to person or property caused by any products sold or otherwise distributed in connection with CYBERLINKHOST,s server.

2.       Any material supplied by the customer infringing or allegedly infringing on the property rights of a third part.

3.       Copyrighted infringement and any defective products sold to customer from CYBERLINKHOST server.

4.       Access delays or interruptions to our website or domain name registration system.

5.       Data non-delivery or misdelivery between customer & CYBERLINKHOST.

6.       Events beyond our control (i.e. acts of God).

7.       The loss of registration or processing of a domain name or the use of a domain name.

8.       the failure for whatever reason to renew a domain name registration.

9.       The unauthorized use of customer's account or any of the services provided to the customers by CYBERLINKHOST.

10.   Errors, omissions, or misstatements.

11.   Deletion of, failure to store, or failure to process or act upon email messages.

12.   Processing of updated information to customer's registration record.

13.   Development or interruption of customer's web site.

14.   Errors taking place with regard to the processing of customer's application

·         CYBERLINKHOST will not responsible in case of loss of an email web contents. However CYBERLINKHOST will try its best and provide all possible assistance to recover the lost data                    

·         The customer will pay the registration fee and hosting charges in advance. Moreover, the customer has to pay at least 50% development charges in advance. If applicable, the customer has to pay in advance the payment of a third party product that is being used in their website i.e. E-merchant Accounts, Commercial Software's Commercial Forums & others, The renewal fee has to be paid by the customer before the due date to keep active his account that includes the domain name and hosting.
